These Terms of Use govern your access to and use of the CardKnow mobile application and related services provided by ToolZone Labs.
These Terms of Use (“Terms”) are a legal agreement between you (“you” or “user”) and ToolZone Labs (ToolZone,” “we,” “us,” or “our”) regarding your access to and use of the CardKnow mobile application, websites, features, content, subscriptions, artificial intelligence features, and related services (collectively, the “Service”).
By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree to these Terms, please do not use the Service.
Our Privacy Policy explains how we collect, use, and protect information. Please read it carefully together with these Terms.
1. Eligibility
You must be at least 13 years old to use the Service. If you are located in the European Economic Area or the United Kingdom, you must be at least 16 years old, or the lower age permitted by local law, to use the Service without parental or guardian consent.
If you use the Service on behalf of another person or entity, you represent that you have authority to accept these Terms on their behalf.
2. The Service
CardKnow provides mobile tools that may include AI-powered search, recognition, generation, organization, analysis, or other content-related features. The Service may change over time, and we may add, modify, suspend, or discontinue features at our discretion.
Some features may require an internet connection, third-party services, device permissions, or an active subscription or purchase.
3. AI Features and Output
The Service may use artificial intelligence systems provided by us or third-party providers. AI-generated output may be inaccurate, incomplete, outdated, offensive, or unsuitable for your specific purpose. You are responsible for reviewing and verifying any AI output before relying on it.
The Service is not intended to provide legal, medical, financial, investment, professional, or safety-critical advice. Do not rely on AI output as a substitute for advice from a qualified professional.
You are responsible for the text, prompts, images, data, or other content you submit to the Service. You must not submit content that you do not have the right to use or that violates applicable law or third-party rights.
4. User Content
You retain ownership of content that you submit, upload, or otherwise provide through the Service (“User Content”), subject to any rights owned by others.
You grant us a limited, worldwide, non-exclusive, royalty-free license to use, process, transmit, display, reproduce, and store User Content only as necessary to operate, provide, maintain, improve, secure, and support the Service, and as otherwise described in our Privacy Policy.
You represent and warrant that you have all rights necessary to submit User Content and to grant the license described in these Terms.
5. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law, regulation, or third-party right.
- Upload, generate, request, or distribute unlawful, harmful, abusive, hateful, harassing, defamatory, obscene, or otherwise objectionable content.
- Exploit, harm, or endanger children or submit personal information about children without appropriate authority and consent.
- Submit sensitive personal information unless the feature specifically requests it and you have the right to provide it.
- Infringe intellectual property, privacy, publicity, or other rights.
- Reverse engineer, decompile, copy, modify, or create derivative works of the Service, except where permitted by law.
- Interfere with, disrupt, overload, or compromise the Service or related systems.
- Attempt to bypass security, access controls, payment systems, subscription limits, or usage limits.
- Use automated systems, bots, scraping, or similar methods without our prior written permission.
- Use the Service to develop, train, or improve competing AI models or services unless we have expressly authorized it.
6. Accounts and Device Access
The core Service may not require account creation. If we offer account features in the future, you are responsible for keeping your account credentials secure and for all activity under your account.
You are responsible for maintaining control over your device and for ensuring that anyone who uses your device complies with these Terms.
7. Purchases, Subscriptions, and Billing
The Service may offer subscriptions, free trials, premium features, or one-time purchases through Google Play. Purchases are processed by Google Play and are subject to Google Play’s payment terms and policies.
Subscription pricing, duration, trial availability, renewal terms, and included features will be shown before purchase. Unless canceled before the end of the current billing period or trial period, subscriptions may automatically renew through Google Play.
You can manage or cancel subscriptions through your Google Play account settings. Deleting the App does not automatically cancel a subscription.
Refund requests are handled according to Google Play’s refund policies and applicable law. We do not receive or store your full payment card details.
8. Intellectual Property
The Service, including its software, design, text, graphics, logos, trademarks, interfaces, and other content, is owned by us or our licensors and is protected by intellectual property and other laws.
Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download, install, and use the Service for your personal, non-commercial use.
No rights are granted to you except those expressly stated in these Terms.
9. Third-Party Services
The Service may include or rely on third-party services, software, APIs, platforms, payment processors, analytics providers, advertising partners, or links. Third-party services are governed by their own terms and privacy policies.
We are not responsible for third-party services, and your use of them may be subject to additional terms.
10. Updates and Availability
We may update the Service to improve functionality, security, compatibility, or performance. Some updates may be required for continued use of the Service.
We do not guarantee that the Service will always be available, uninterrupted, error-free, or compatible with every device or operating system.
11. Termination
You may stop using the Service at any time. We may suspend or terminate your access to the Service if we reasonably believe that you have violated these Terms, created risk or legal exposure for us or others, abused the Service, or used the Service in a way that may harm users, third parties, or our systems.
Upon termination, your right to use the Service will end immediately. Sections that by their nature should survive termination will continue to apply, including provisions relating to intellectual property, disclaimers, limitation of liability, and dispute terms.
12. Disclaimers
The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and reliability.
We do not guarantee that AI output or other Service content will be accurate, complete, safe, lawful, or suitable for your intended use.
13. Limitation of Liability
To the maximum extent permitted by law, ToolZone Lab and its affiliates, officers, directors, employees, agents, partners, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenues, data, goodwill, or business opportunities, arising out of or related to your use of or inability to use the Service.
To the maximum extent permitted by law, our total liability for any claim arising out of or related to the Service or these Terms will not exceed the amount you paid to us for the Service during the three months before the event giving rise to the claim, or USD 50, whichever is greater.
14. Indemnification
You agree to defend, indemnify, and hold harmless ToolZone Lab and its affiliates, officers, directors, employees, agents, partners, and licensors from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to your User Content, your use of the Service, your violation of these Terms, or your violation of applicable law or third-party rights.
15. Governing Law
These Terms will be governed by the laws applicable in the jurisdiction where ToolZone Lab is established, without regard to conflict of law principles, unless mandatory consumer protection laws in your jurisdiction require otherwise.
If a dispute arises, you agree to first contact us at support@cardsknow.com so we can try to resolve the issue informally.
16. Changes to These Terms
We may update these Terms from time to time. When we do, we will post the updated version and update the “Last Updated” date. If changes materially affect your rights or obligations, we will provide notice where appropriate.
Your continued use of the Service after the updated Terms become effective means that you accept the updated Terms.
